Eligibility in Minnesota
The child will be eligible and receive special education instruction if he or she meets both of these criteria's:
1. Signed documentation by a licensed physician that child is medically diagnosed with an acute or chronic health issue but if it is a diagnosis of ADD or ADHD, documentation (written and signed) is completed by a licensed physician, an advanced practical nurse, or a licensed psychologist.
2. The health impairment has to affect the child's completion of educational tasks by three or more of the following situations:
- Excessively absent due to health issue (hospitalization, surgeries, medical treatments, etc)
- Health care procedures that need to be completed during the day
- Medications that constantly affect comprehension, memory, attention or fatigue
- Limited physical strength that results to not being able to perform in different school activities
- Limited endurance in which it decreases stamina to continue performance
- Difficult time focusing
- Difficulty of managing time and organization to complete assignments within routines
- Defected ability to follow directions or complete a task
